The High Court has directed a special tribunal in Comilla to dispose as soon as possible of a bail petition filed by BNP Chairperson Khaleda Zia in a case filed in the district over the February 3, 2015 arson attack.
The bench of Justice Md Shawkat Hossain and Justice Abu Taher Md Saifur Rahman passed the order on Monday after hearing a petition filed by Khaleda’s lawyer in the case.
Advocate Khandaker Mahbub Hossain stood for Khaleda while Attorney General Mahbubey Alam, accompanied by Deputy Attorneys General AKM Amin Uddin Manik and Moniruzzaman Rubel, represented the state.
The High Court on Sunday had adjourned the hearing on the bail petition until Monday.
On June 5, the BNP chief’s lawyers filed the plea in the case filed under the Special Powers Act.
On February 3, 2015, eight people were killed in a petrol bomb attack on a bus at Jogmohanpur in Comilla’s Chouddagram upazila during a movement waged by the BNP-led 20-party alliance.
After the incident, three cases - one for killing, one under the Explosive Substances Act, and the other under the Special Powers Act - were filed at the Chouddagram police station against Khaleda and several top BNP leaders.
Meanwhile, the Appellate Division on Monday upheld a High Court order that had asked the lower court to dispose the BNP chairperson’s bail pleas speedily in connection with two defamation cases.
Chamber Judge of the Appellate Division Justice Hasan Foez Siddique had passed the order.
The attorney general, along with Deputy Attorney General AKM Amin Uddin, then filed two separate leave-to-appeal petitions with the Supreme Court challenging the High Court order yesterday morning, said Khaleda's lawyer Masud Rana.
He said, after hearing the petitions, the chamber judge upheld the High Court order and sent the petitions to the full bench of the apex court for their hearing on June 25.
On May 31, the High Court had ordered the Dhaka trial court to speedily hear and dispose of two bail pleas filed by Khaleda in these cases.
The bail petitions were filed on May 22.
One of the cases was a defamation suit filed by Bangladesh Jananetri Parisad President AB Siddik on November 3, 2016 against the BNP chief for distorting history of the 1971 Liberation War and demeaning the national flag and the country’s map.
The other case was filed by journalist Gazi Jahirul Islam on August 30, 2016 accusing Khaleda of celebrating her birthday on August 15 based on false information.
