Writ challenges EC decision on 25 Jamaat leaders’ candidacies

Four Bangladesh Tarikat Federation leaders filed the petition

A writ petition has been filed with the High Court challenging the Election Commission’s decision to approve the candidacies of 25 Jamaat-e-Islami leaders for the upcoming 11th general election. 

Barrister Tania Amir filed the petition on Wednesday, on behalf of four leaders of Bangladesh Tarikat Federation—including Secretary General Syed Rezaul Haque Chandpuri. 

The bench of Justice JBM Hassan and Md Khairul Alam will hear the petition on Thursday. 

Barrister Tania said since Jamaat’s registration was revoked following a High Court ruling the party leaders cannot contest the election using their party symbol.

Currently the Jamaat leaders are contesting the election using their political ally, BNP’s, sheaf of paddy symbol; and some are contesting as independent candidates. 

“By allowing the Jamaat leaders to contest the election using the sheaf of paddy symbol, and as independent candidates, the Election Commission is not complying with the High Court order and Representation of the People Order,” she said. 

As many as 22 Jamaat leaders are contesting the December 30 election using BNP’s sheaf of paddy, while three are running as independent candidates. 

The High Court cancelled Jamaat's registration with the Election Commission on August 1, 2013.

The Election Commission finally issued a gazette notification on October 29 this year confirming the cancellation of the party's registration.

Jamaat openly sided with Pakistani forces in 1971 and actively tried to thwart the country's struggle for freedom. Several of its top leaders have been convicted of war crimes and crimes against humanity.

Earlier, four people, including Chandpuri, filed a petition with the Election Commission challenging the legality of the Jamaat leaders' nominations.

Later, they filed a writ petition with the High Court as the commission did not respond to their appeal. 

The High Court, on December 18, asked the Election Commission to dispose the writ filed against the 25 Jamaat candidates contesting the election using BNP's sheaf of paddy symbol, within three days.
