HC: Why would stand release of Pirojpur judge not be declared illegal?

The High Court on Wednesday questioned the legality of a government decision to stand release Pirojpur District and Sessions Judge Abdul Mannan, who was transferred within hours after he rejected bail petition of a former lawmaker and his wife and ordered sending them to jail.

In a rule, the HC asked Secretary of the law and justice division of the Ministry of Law to explain in seven days why the decision regarding the judge should not be declared illegal.

The bench of Justice Tariq-ul Hakim and Justice Md Iqbal Kabir passed the order on a suo moto move when Supreme Court lawyer Barrister Abdul Qaiyum placed the news report before the HC bench for the necessary order. Advocate Yunus Ali Akand also stood for the matter.

Earlier on the same day, two other lawyers went to High Court benches seeking necessary order over the transfer order.

Advocate Shishir Manir brought media report to the bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman.

The court asked him to visit chief justice for the matter as the later is the guardian of the judiciary. 

Barrister Syed Saidul Haque Sumon went to the HC bench of Justice Nazrul Islam Talukder and KM Hafizul Alam, but the court asked him to come back after filing a writ petition.

The government on Tuesday passed a stand release order on Pirojpur District Judge Abdul Mannan and attached him to the law ministry hours after he ordered former lawmaker of Pirojpur-1 AKMA Awal  and his wife to jail after rejecting their bail pleas in three graft cases.

After the initial rejection of their bail pleas, the district headquarters also witnessed demonstrations and roadblocks by the supporters of former ruling party lawmaker Awal, also the president of Pirojpur district Awami League.

In protest against the court order, supporters of Awal demonstrated on the court premises and in the district town. They also blocked several roads.

Following the development, Nahid Nasrin, joint District and Sessions Judge of Pirojpur took charge of the district court as an acting district judge in the afternoon and granted bail to the couple.

Why Judge Abdul Mannan was ordered stand released?

The district judge was put on stand release after he behaved in a rude and indecent manner with lawyers while hearing the bail petition of former Pirojpur lawmaker and his wife, Law Minister Anisul Huq said.

The district and session judge’s rude behaviour with everyone resulted in a situation where all the lawyers from bar decided to boycott his court, he said while talking to reporters at the law ministry on Wednesday.

When such chaos was going on in the court, people came out to the street. To control the situation, he was given stand release following a proposal from Law Ministry, said the minister.

It is always upon the court whether to grant or reject bail petitions, but if the court creates a situation where the chances of maintaining law and order come under question, action needs to be taken, he added.

To control the situation, bail was granted to the Pirojpur district AL president and his wife, and “I do not think it is a deviation from the rule of law,” said Huq.

Law Minister, ACC chairman's resignation demanded

Terming Tuesday's incident as a naked interference on judicial independence, Supreme Court Bar Association Secretary Barrister AM Mahbub Uddin Kokon on Wednesday

demanded the resignation of Law Minister Anisul Huq and Anti Corruption Commission (ACC) Chairman Iqbal Mahmud.

At a press conference, he also demanded an investigation of the incident under a High Court Justice.

Dr Iftekharuzzaman, executive director of Transparency International Bangladesh (TIB), also expressed concern over Judge Abdul Mannan’s transfer in a press release on Wednesday.

This incident will further empower political influence over the court and influential, powerful figures of the society will take advantage of this unlawful state, he said.

Awal: “Corrupt Minister Rezaul behind this”

Former Awami League lawmaker Awal, who is accused in three graft cases, on Wednesday brought corruption allegations against Fisheries and Livestock Minister S M Rezaul Karim.

A day after he secured bail in corruption cases, Awal alleged that the minister influenced Judge Abdul Mannan for not granting his bail.

Speaking at a press conference at the party office in Pirojpur, he also alleged that minister Rezaul Karim is undermining party’s dedicated leaders and choosing those involved in the politics of BNP and Jamaat for different posts.

Bringing graft allegations against the minister, Awal alleged that minister Rezaul illegally grabbed a contract work of Tk100 crore involving his brothers. 

He also claimed that minister Rezaul gave contracts to businessman and Jubo League leader Golam Kibria Shamim alias GK Shamim after taking three cars as a gift from him.

He also accused Rezaul Karim of resorting to falsehood about his participation in the Liberation War when he was only nine years old in 1971.

Minister S M Rezaul Karim is the first time lawmaker and replaced Awal in 11th parliamentary elections in Pirojpur-1 constituency.
