Rape case: HC releases 4 children in a rare verdict in night

The bench passed the order on Thursday at 9pm after learning about the incident from the media

The High Court has directed the judge of the Children's Court in Barisal to grant bail to four children who were sent to Jessore Juvenile Correctional Centre on charges of rape.

In a rare event, the bench of Justice Md Mozibur Rahman Miah and Justice Mohi Uddin Shamim passed the order on Thursday at 9pm after learning about the incident from the media.

The court ordered the deputy commissioner of Jessore to send the four children to their parents immediately within the night.

The court also asked the concerned judicial magistrate of the district to appear before the High Court bench on Sunday.

The officer-in-charge (OC) of Bakerganj police station, the four children along with their parents are also directed to be present that day, Supreme Court spokesperson Saifur Rahman confirmed the matter.

On Sunday, the four boys, aged seven to nine, were playing with a girl. On Tuesday, the girl’s father filed a case with Bakerganj police station accusing the four boys on charges of rape.

The court also ordered the director of Barisal Medical College Hospital to send the medical reports of the girl to the High Court bench within 10:30am on Sunday.

Bakerganj police station OC Abul Kalam was ordered to ensure that the children reach their parents within Thursday night and also report to the special officer of the High Court on the next day confirming that the children had reached safely.

Following the directive of the court, the High Court special officer telephoned the judge of Barisal Children’s Court, the deputy commissioner of Barisal, the director of Barisal Medical College Hospital, the chief judicial magistrate, concerned senior judicial magistrate, and the OC of Bakerganj police station to inform them regarding the matter. 

The judge of Barisal Children's Court has already granted bail to these children, he added.

Meanwhile, Bakerganj OC Abul Kalam said: “Necessary steps have been taken to bring back the children form Jessore Juvenile Development centre immediately after receiving the court order.
