NSU student Payel killing: Driver, 2 others gets death penalty

On July 23, 2018, Gazaria police of Munshiganj recovered the body of Payel from a canal under a bridge in Bhater Char area

A tribunal in Dhaka has sentenced three people – a driver, his assistant, and supervisor of a Hanif Paribahan bus – to death for killing North South University (NSU) student Saidur Rahman Payel in 2018.

Judge Abu Zafar Md Kamruzzaman of Dhaka Speedy Trial Tribunal 1 delivered the verdict on Sunday in presence of the convicts, confirmed Special Public Prosecutor Md Abdullah Abu Bhuiyan.

The convicts are bus driver Md Jamal Hossain, his assistant and brother Foysal Hossain, and supervisor Md Jony.

Payel's maternal uncle Golam Sarwardi Biplob, who filed a murder case against the trio, expressed his satisfaction after the verdict while the defence said they will file an appeal with the High Court against the death sentence.

Court’s observation 

The court, during the verdict, said that road accidents in the country are getting worse by the day.

Road accidents are now more common due to incompetent drivers, reckless driving, and unfit vehicles, it said.

“The deaths of so many people on the roads every day….are these just accidents or murders….the question has arisen in the minds of the people,” said Judge Abu Zafar Md Kamruzzaman of Dhaka Speedy Trial Tribunal 1, adding: “Every road has become a death trap.”

The court said that people of all ages have now become victims of road accidents and it has become a death trap.

Even pedestrians standing on the footpaths are not spared by reckless bus drivers. The procession of death on the roads is getting longer day by day, it added.

Mentioning road accidents related statistics, the court said: “When will we become aware?” 

The court also said that the deceased Payel was a meritorious student.

However, he was preparing himself to serve the country by pursuing higher education but had to die early due to the cruelty of the bus driver, supervisor, and their assistant. 

The court also gave four specific observations to reduce road accidents in the country.  

They are:

- Drivers, supervisors, and their assistants must take dope tests before being allowed to drive or operate vehicles

- Bus staff quite regularly misbehave with passengers. They will have to be provided with behavioral training and counselling

- There has to be a sufficient number of modern toilets installed for the general people in every 3km of the country’s highways and for this, bus owners will pay a monthly fee to the government

- And lastly, CCTV cameras need to be installed for monitoring traffic on the highways

Payel, A resident of Halishahar in the port city of Chittagong, Payel was a fifth-semester student of Bachelor of Business Administration (BBA) at the NSU.

On July 21, he was returning to Dhaka from Chittagong on a Hanif Paribahan bus with friends.

According to police, the bus got stuck in a traffic jam in Gazaria around 4am on July 22.

After some time, Payel disembarked to relieve himself. When the gridlock eased, he rushed back to get on. At that moment, he was hit by the bus and lost consciousness.

The driver, his assistant, and supervisor threw Payel into the canal -- presuming that he was dead. 

On July 24, police arrested the supervisor from Motijheel and the driver and his helper from Arambagh in the capital.

Golam Sarwardi filed a murder case against the three at Gazaria police station.

Although, the trial of the case started in a court in Munshiganj, the case was later transferred to a Chittagong speedy trial tribunal upon the application of the victim's family.

On April 2, 2019, acting judge of Chittagong Divisional Speedy Trial Tribunal Abdul Halim framed charges against the three accused and started the proceedings of the trial.

However, the case was transferred again to the Dhaka Speedy Trial Tribunal 1 on November 18, 2019, as per an order by the High Court upon the application of the defence.
