Evaly bosses Rassel, Shamima now sued over delivery failure

A lawyer has started the case against 10 people with a Dhaka court

Another case has been filed against Evaly CEO Mohammad Rassel and his wife Evaly Chairperson Shamima Nasrin over the controversial online marketplace’s failure to deliver a product on time.

Eight others were also accused in the case started by Alamgir Hossain Regan, a lawyer, with the court of Dhaka Metropolitan Magistrate Begum Mahmuda Akter on Monday, according to media reports.

The court took the case into cognizance and ordered Khilgaon police to investigate and submit their findings.

According to the plaintiff, he ordered a motorcycle from the e-commerce platform through its “Cyclone offer” on May 1 and made a payment of Tk70,999 through the Nagad app on May 3.

Although Evaly policy promises to deliver products to its customers between seven to 45 days, he did not receive the motorcycle after 149 days -- leading the lawyer to take legal steps.

Rassel and Nasrin were arrested in another case on September 16, after allegations of fraud and embezzlement rose against Evaly in light of the company’s failure to deliver products.

The couple has already spent multiple days in police remand in two cases filed with Gulshan police. They have been accused in a number of cases around the country since the controversies started.

Earlier this month, the Commerce Ministry had asked the Home Ministry to take legal actions against Evaly for violating laws and deceiving customers.

The company had informed the Commerce Ministry that they owe Tk311 crore to customers and Tk206 crore to the merchants. However, following his arrest, Rassel told RAB that Evaly owes over Tk1,000 crore to customers and merchants.
