Attorney general: Actions to be taken against Ruhul Amin's lawyer

Defence lawyer in sacked Awami League leader Ruhul Amin's case will be punished for misleading the court, Attorney General Mahbubey Alam has said.

He made the comments at his own office, after the High Court on Saturday revoked Ruhul Amin's one-year interim bail in the case over gang-raping a woman in Subarnachar upazila of Noakhali - right after the December 30 election. 

The attorney general said: "Ruhul's lawyer Ashek-e-Rasul appealed to the High Court to secure Ruhul's bail in the sensational Subarnachar case. He informed us that the hearing would be held with the bench of Justice M Enayetur Rahim. 

"However, the lawyer held the hearing with the bench of Mamnoon Rahman instead, and secured Ruhul's bail, after misleading the court by hiding information regarding Ruhul's confession and the victim's statement," Mahbubey further said.

Later, the attorney general's office informed the affiliated justices about the matter, whereupon a High Court bench of Justice Mamnoon Rahim and Justice SM Kuddus Zaman revoked Ruhul's bail on Saturday morning - a day of their weekend. 

"His previous interim bail has been recalled," the attorney general said. "We will inform prison authorities of the matter, so that Ruhul cannot get out of jail."

He added: "This is a kind of cheating, and a contempt of court. We will bring the issue to the chief justice's notice, that a few lawyers sometimes mention one bench, but produce the case before another bench."

If necessary, the matter will also be brought to the bar council's attention, so that actions can be taken against Ruhul's lawyer, Mahbubey said.

He reassured that if the all information regarding the case had been produced in front of the court, it would not have granted the bail petition. 

"I will appeal to the court to pass an order for taking actions against Ashek-e-Rasul," the attorney general said. "The hearing will be held on March 25."

Calling the incident "unprecedented", Mahbubey said the whole nation was shocked when the High Court granted bail to Ruhul - the prime accused in a gang-rape case. 

"However, I extend my gratitude to the High Court, that they promptly took actions to revoke the bail, even on their weekend," he said.
