Probe report: Rafia died due to medical negligence

Investigation team finds that the doctors and nurses of Max Hospital failed provide proper services

A probe committee led by the Chittagong civil surgeon has found evidences of negligence of the on-duty physicians, nurses and authorities of Max Hospital that resulted into the death of a two-year-old girl named Rafia Khan.

The Chittagong Journalists’ Union (CUJ) disclosed the findings of the probe team on Friday after holding a press briefing at the Chittagong Press Club in the city.

According to the report, the concerned doctors did not have the required experience and sincerity when the baby developed severe convulsion. The on-duty nurses also did not have the knowledge or expertise to face the emergency situation.

It also revealed that the accused physician, Dr Bidhan Roy Chowdhury, did not treat the patient seriously.

The committee also found true the allegation of the child’s parents that Dr Debashish Sen Gupta and Dr Shuvra Dev did not provide sincere services when her condition deteriorated.

The 28-month-old daughter of journalist Rubel Khan died on June 29 at Max Hospital while undergoing treatment of cold and sore throat.

Later, Rubel alleged that Rafia died due to negligence and wrong treatment at the privately-run hospital.

The three-member probe committee, headed by Chittagong Civil Surgeon Dr Azizur Rahman Siddique, was formed by the Health Ministry afterwards to investigate the allegations.

Apart from discovering a total of 11 irregularities at Max Hospital, it also found that the child’s parents had to suffer while admitting their daughter into the errant hospital.

There was lack of coordination between the nurses and doctors and lack of proper monitoring during the treatment. The hospital is seriously lacking in medical management front due to inexperienced nurses and physicians, according to the probe report.


The probe team in its report also made a four-point recommendation for the hospital authorities to improve its condition:

  • Taking necessary steps against the three on-duty physicians charged with negligence
  • Taking immediate steps to improve the faulty medical management
  • Ensuring proper healthcare services through nurses with diploma degrees (as per rules, a hospital must recruit nurses with such degrees. But Max Hospital has no such qualified nurses.)
  • Ensuring full-time, quick and sincere services by specialized doctors


The 11 irregularities found at Max Hospital included renewal of the hospital’s licence completed without following due course, no appointment letters for the doctors and nurses, no information about hospital staff, unapproved operational pathological lab and absence of blood bank, among others.

The probe report also recommended that the hospital authorities be given 15 days to rectify these irregularities, or face closure.

In an interaction at Chittagong Press Club on Thursday, journalists had demanded closure of the hospital as its medical negligence had cost the life of a child.

The journalist leaders also called for bringing the hospital staff responsible for Rafia’s to book and giving them exemplary punishment.

They also urged the Anti-Corruption Commission to look into the hospital authorities' "questionable" source of income, which reportedly has enabled them to reap profits despite operating without approval from the Directorate General of Health Services and Bangladesh Medical and Dental Council.
