HC for taking care of tortured madrasah student’s study

Mawlana Md Yahia Islam was seen whipping a child student at a madrasa in Chittagong's Hathazari municipality on March 9

The High Court on Sunday asked the authorities concerned to take care of the study of a student, who was beaten up mercilessly by his teacher for crying to go home with his mother from Markazul Islami Academy Hafezia Madrasah in Chittagong Hathazari, so that it cannot be hampered in anyway. 

The court also directed all educational institutions in the country, including madrasas, to abide by the constitution and the prevalent laws.

The High Court bench comprising Justice FRM Nazmul Ahsan and Justice Shahed Nuruddin passed the order on Sunday after reviewing the reports submitted by the local administration on the child abuse case in Hathazari, reporte Bangla Tribune.

Chittagong Deputy Commissioner Mohammad Mominur Rahman, local police superintendent, OC and madrasa authorities submitted a report to the High Court on the steps taken in the incident.

Presenting the reports to the court, Deputy Attorney General (DAG) Barrister ABM Abdullah Al Mahmud said the accused teacher Mawalana Md Yahia has already been sent to jail and he has been sacked by the Madrasa authorities.

“The higher authorities have been informed about the incident and the madrasah authorities have been warned through the upazila nirbahi officer (UNO),” the DAG informed the court, reports UNB. 

Adequate measures have been taken at the child’s hometown to ensure his safety. 

The court after that said incidents of physical, mental and even sexual torture are taking place in madrasas across the country.

“Court has already given directions in this regard. Madrasah authorities have to be alert so that these directions are implemented appropriately,” the court said.

According to the reports, the child’s parents, being extremely religious, had decided not to sue their child’s teacher because it looks indecent. 

Later, the police decided to file a case as a plaintiff.

Earlier on March 11, the High Court had directed concerned DCs, SPs and OCs to submit a report regarding the steps taken in the incident of torturing a child student at a Madrasa in Hathazari, Chittagong.

The concerned people submitted the report to the High Court as per the instructions.

Earlier, on March 9, teacher Md Yahia Islam whipped a child student at a madrasa in Chittagong's Hathazari municipality. Later, when the video of the torture went viral, there was widespread criticism.
